These Terms and Conditions (“Terms”) govern your use of the Legend Hollow website located at https://legendhollowga.com (the “Site”).

By accessing or using the Site, booking or registering for any Legend Hollow activity, event, stay, or membership through the Site, or visiting Legend Hollow in person, you agree to be bound by these Terms. If you do not agree, you must not use the Site or participate in Legend Hollow Activities.

Legend Hollow reserves the right to withdraw linking permission at any time, in its sole discretion. If Legend Hollow requests that you remove a link to the Site, you agree to do so promptly.

Accident Waiver, Release of Liability, Assumption of Risk, and Indemnification

In consideration of being allowed to access, enter, use, attend, observe, participate in, purchase, book, register for, volunteer at, or otherwise make use of any Legend Hollow property, facilities, lodging, programs, services, activities, events, equipment, improvements, trails, parking areas, roads, vehicles, or any related offerings, including those located a457 Legend Hollow Road, Lyerly, Georgia 30730 (collectively, “Legend Hollow Activities”), you agree to the following.

For purposes of this section, the “Released Parties” means Legend Hollow Wilderness Education Center LLC, Just Love Forest LLC, Scot Hollonbeck, and each of their respective owners, members, managers, officers, directors, employees, volunteers, contractors, agents, representatives, affiliates, landowners, sponsors, partners, successors, and assigns.

This section applies to all visitors, guests, registrants, participants, members, volunteers, contractors, invitees, and any other persons who enter the property, participate in Legend Hollow Activities, or otherwise make use of Legend Hollow’s services or facilities, whether or not such person completes an online purchase, registration, reservation, or membership transaction.

By accessing the Site, checking any box indicating agreement to these Terms, completing a booking, registration, reservation, or purchase, entering the property, or participating in any Legend Hollow Activities, you acknowledge that you have read, understand, and agree to this section and the full Terms.

You understand and acknowledge that outdoor recreation, wilderness activities, lodging stays, volunteer work, maintenance projects, educational programs, events, gatherings, transportation-related activity, property access, and all other Legend Hollow Activities involve known and unknown risks, inherent risks, and other risks that may result in bodily injury, emotional injury, illness, exposure to disease, disability, paralysis, death, property damage, financial loss, or other harm to you or to third parties.

These risks may include, without limitation, slipping, tripping, and falling; falling trees, limbs, rocks, or other objects; uneven terrain; mud; water hazards; fire; animals, insects, snakes, and hazardous plants; weather and temperature extremes; lightning; remote conditions; delayed emergency response; food- or drink-related illness or reaction; dehydration; exhaustion; overexertion; equipment failure; misuse of tools or machinery; lodging-related hazards; roadway and parking hazards; the acts, omissions, or conduct of other guests, visitors, volunteers, participants, or third parties; and the negligence of one or more Released Parties.

You understand that the Released Parties may not be aware of your health, medical condition, skill level, judgment, physical limitations, allergies, or fitness for any activity; may make mistakes in judgment; may provide incomplete or inaccurate warnings or instructions; and may encounter environmental, operational, equipment, staffing, or emergency circumstances that cannot be fully anticipated or controlled.

If you choose to use any tools, machinery, equipment, vehicles, parking areas, trails, facilities, lodging areas, or other property features, you do so voluntarily and at your own risk. You accept full responsibility for using reasonable judgment, acting within your own skill and ability, and protecting your own safety and the safety of others.

You represent that you are physically and mentally able to participate in any Legend Hollow Activities you choose to undertake, that you will not participate in any activity for which you are not adequately prepared, and that you accept full responsibility for consulting with a qualified medical professional regarding any condition that may affect your participation or presence on the property.

You expressly and voluntarily assume all risks of injury, illness, damage, loss, or death arising from or related to access to the property, participation in Legend Hollow Activities, presence on the property, use of facilities or equipment, or interaction with other participants, guests, or third parties, whether such risks are known or unknown, inherent or otherwise.

To the fullest extent permitted by law, you release, waive, discharge, and covenant not to sue the Released Parties from any and all claims, demands, causes of action, liabilities, damages, losses, costs, or expenses of any kind, whether at law or in equity, arising out of or related in any way to your presence on the property, participation in Legend Hollow Activities, use of facilities, equipment, lodging, or services, or any injury, illness, death, or property damage you may suffer, including claims based on the negligence of any Released Party.

You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, actions, suits, liabilities, losses, damages, judgments, settlements, penalties, fines, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your acts or omissions, your presence on the property, your participation in Legend Hollow Activities, your breach of these Terms, or any claims brought by or on behalf of your family members, minors, guests, invitees, or other third parties connected to you.

You consent to emergency medical care, transportation, and treatment deemed reasonably necessary in the event of injury, illness, or emergency, and understand that the Released Parties are not obligated to provide such assistance. You accept full responsibility for any resulting medical, transport, rescue, or related costs.

You understand that photographs, video, audio, or other recordings may be captured in connection with Legend Hollow Activities and grant permission for your name, image, likeness, voice, and appearance to be used by Legend Hollow and its designees for lawful promotional, educational, editorial, documentary, and business purposes, without compensation, unless prohibited by law.

You certify that you carry, or elect not to carry, your own health, medical, liability, travel, property, and other insurance and accept full financial responsibility for any injury, illness, damage, or loss you may sustain or cause.

If you bring any claim notwithstanding this section, such claim must be brought exclusively in the courts of the State of Georgia located in DeKalb County, Georgia (unless applicable law requires otherwise), and Georgia law will govern these Terms and any dispute arising from them, without regard to conflict-of-law principles.

If any provision of this section is found unenforceable, invalid, or contrary to law, the remaining provisions will remain in full force and effect and will be construed to the maximum extent permitted by law.

You acknowledge that you have had the opportunity to review these Terms in full and understand that you are giving up substantial legal rights by agreeing to them, including the right to sue the Released Parties for claims covered by this waiver and release.

Membership & Access

Access to Legend Hollow property, facilities, lodging, programs, services, activities, events, and related offerings is limited to persons who hold a valid membership issued by Legend Hollow, LLC or who receive a qualifying temporary or bundled membership through an eligible registration, booking, reservation, event, activity, stay, promotion, or other offering expressly designated by Legend Hollow. Membership and access rights are personal, conditional, revocable, and subject at all times to these Terms, including the Accident Waiver, Release of Liability, Assumption of Risk, and Indemnification provisions above.

Legend Hollow may offer one or more categories of membership, including without limitation standard memberships purchased directly, promotional memberships, complimentary memberships, temporary memberships, and memberships bundled into qualifying events, activities, stays, or other offerings. The type, duration, scope, renewal status, privileges, limitations, and eligibility rules for any membership are determined solely by Legend Hollow and may vary by product, promotion, event, or offering.

A membership bundled into an event, activity, stay, or other offering applies only as expressly stated at the time of purchase or registration. Unless Legend Hollow clearly states otherwise in writing, a bundled or temporary membership grants only the limited access associated with that offering and only for the dates, times, duration, and scope identified by Legend Hollow. Participation in one event, activity, or stay does not create a continuing right of access beyond the included membership period or beyond the specific privileges associated with that registration.

Where a booking, event, or activity includes membership for the applicable participant, that bundled membership satisfies the membership requirement only to the extent and for the duration described for that offering. Where no bundled membership is included, an active standalone membership is required before access, participation, or use is permitted, unless Legend Hollow has expressly authorized a non‑member presence in writing.

Each membership is issued only to the individual person identified in the applicable account, registration, or purchase record, unless Legend Hollow expressly designates a different structure in writing. Memberships are non‑transferable, non‑assignable, and may not be shared, resold, sublicensed, or used by any person other than the approved member. Legend Hollow may require identity or account verification, participant matching, or other reasonable steps to confirm eligibility for membership‑based access.

Members and all persons accessing Legend Hollow through a membership or bundled membership must comply with these Terms and all additional posted or communicated rules, instructions, eligibility standards, safety requirements, property rules, booking rules, event requirements, and operational policies. Members are responsible for the conduct of any guests, invitees, dependents, or associated persons they bring, register, sponsor, or accompany, to the extent permitted by the applicable offering.

All fees, dues, charges, deposits, event fees, booking amounts, taxes, service charges, and other sums associated with membership or membership‑based access are due as stated at the time of purchase, registration, renewal, or booking. Unless expressly stated otherwise in writing, membership fees and related charges are non‑refundable once purchased, activated, or used, and failure to use a membership does not entitle the purchaser or member to a refund, credit, pause, or extension.

Membership does not create any ownership interest, leasehold, tenancy, easement, or guaranteed right of access to Legend Hollow property or facilities. All access remains subject to availability, operational needs, safety considerations, weather, staffing, land conditions, maintenance, private scheduling, event calendars, capacity limits, and any other limitations established by Legend Hollow in its sole discretion. Legend Hollow reserves the right to limit, deny, postpone, reschedule, restrict, or condition access to any area, facility, activity, or event at any time.

Legend Hollow may suspend, restrict, revoke, terminate, or refuse membership or access privileges at any time, without refund except where required by law, for safety reasons, policy violations, failure to complete required documentation, nonpayment, misuse of membership privileges, inaccurate registration information, unauthorized sharing or transfer of access, prohibited conduct, harm to people or property, disruption of operations, suspected fraud, unlawful conduct, or any other conduct inconsistent with the purposes, safety standards, or operational requirements of Legend Hollow. Legend Hollow may remove any person from the property or deny future entry where that person lacks the required membership status, refuses to comply with these Terms, fails to complete required waivers or acknowledgments, violates property or conduct rules, presents a safety concern, or otherwise acts inconsistently with Legend Hollow’s standards.

Participation by Minors

If you are a parent or legal guardian completing a registration, booking, reservation, or purchase on behalf of a minor — meaning any person under the age of 18 — you agree to all terms, conditions, waivers, releases, and indemnification provisions contained in these Terms on behalf of yourself and that minor. You represent that you have full legal authority to bind the minor to these Terms and that the minor will be under your direct supervision, or the supervision of a responsible adult you have specifically authorized, during all Legend Hollow Activities.

You expressly assume all risks described in these Terms on behalf of the minor and agree to release, waive, discharge, and indemnify the Released Parties from any and all claims arising from the minor's presence on the property, participation in Legend Hollow Activities, or use of any facilities, equipment, or services, to the fullest extent permitted by Georgia law.

You acknowledge that Georgia law may limit the enforceability of liability waivers on behalf of minors in certain circumstances, and you agree that any such limitation shall not affect the enforceability of the remaining provisions of these Terms as applied to you individually.

Changes to Terms

Legend Hollow may update these Terms from time to time. The updated Terms will be posted on the Site with a revised “last updated” date. Your continued use of the Site or participation in Legend Hollow Activities after any changes are posted means you accept the updated Terms.
